Tribal Court

Thlopthlocco Tribal Town is a federally recognized Indian Tribe, organized under the Oklahoma Indian Welfare Act of June 26, 1936, and governed by a Federal Charter and Tribal Constitution. As a sovereign nation, the Tribe exercises self-government through its Business Committee, which holds the constitutional authority to transact business and act on behalf of the town in all matters.

In 2009, the Business Committee adopted Tribal Resolution No. 2009-29, establishing the Thlopthlocco Tribal Town Judicial Code. This resolution created a formal tribal judiciary to independently adjudicate internal Thlopthlocco matters, reflecting the Tribe's commitment to self-determination, reduced reliance on outside sovereigns for resolving internal disputes, and the full exercise of its Indian sovereignty. The resolution was adopted unanimously, by the business committee.

The Court holds broad civil, criminal, and juvenile jurisdiction over Indian Country within the Tribe's territorial boundaries, applying the Tribe's Constitution, treaties, statutes, and common law. Where tribal law is silent, the Courts may draw on analogous federal or state legal standards or Department of Interior regulations.

The Code also provides for judicial independence from the Tribe's legislative and executive functions, sets qualifications and terms for Judges and Justices, and establishes a Court Clerk's Office responsible for maintaining records, dockets, and administrative functions of the Courts.

Through this Judicial Code, Thlopthlocco Tribal Town affirms its authority to govern its own affairs and provide for the general welfare of its people through a fair, independent, and accountable tribal justice system.
